GENERAL CONDITIONS FOR THE RETURN OF GOODS PURCHASED BY BUYERS WHO ARE ENTREPRENEURS

(1) Under the terms of these General Terms and Conditions of Return of Goods (hereinafter “GTC”), goods purchased from Master-Sport-Automobiltechnik (MS) Production-Distribution Center Wieslaw Rutka, based in Gorlice, ul. 11 listopada 68, 38-300 Gorlice, (hereinafter “Master Sport”) may be returned regardless of the form of purchase (stationary store, online store) within a period not exceeding 1 (one) year from the date of conclusion of the contract of sale, provided that the Buyer who is an entrepreneur (hereinafter “Buyer”) submits a written request for return of goods and obtains Master Sport’s prior written or e-mail consent to return the goods.

(2) Specific goods produced on the individual order of the Buyer shall not be returned.

(3) Submission of an application for the return of goods is tantamount to the Buyer’s acceptance of the terms and conditions of the GTCs posted on the Master Sport website.

4th Buyer is entitled to return the goods at the office of Master Sport or by shipping the goods at his own expense to the address of Master Sport headquarters, i.e. 11 November 68 Street, 38-300 Gorlice. In order to return the goods the Buyer is obliged to send or present a proof of purchase of goods and shipping documents/letter of goods. Proof of purchase is a VAT invoice (in electronic or paper form).

(5) Master Sport after the final acceptance of returned goods in accordance with the content of paragraph 9, will return to the Buyer the sales price (subject to the content of paragraph 10) reduced by 40% of the value of the goods sold (when the delivery of goods to the Buyer was at the expense of Master Sport the sales price to be returned is further reduced by the cost of transportation of the goods). The aforementioned amount is intended to cover Master Sport’s loss resulting from the reduction in the value of the goods, to cover operating costs related to the handling of the return of goods, in particular Master Sport’s verification of the quality and fulfillment by the goods of the original characteristics of the returned goods (among other things, in accordance with the provisions of paragraph 6), and the cost of legal and accounting support of the process of returning goods.

(6) Goods that meet the following criteria shall be returned;
(a) at the time of return, the goods are in the same technical condition as when they were issued to the Buyer,
b) the goods are originally packaged,
c) despite the lack of fulfillment of the condition described in b), unpacked goods without original packaging may also be returned, provided they do not bear traces of wear and tear or bear only such traces of use that result from using them in a manner necessary to ascertain their nature, characteristics and functioning.

7. goods damaged or bearing traces of use shall not be returned.

(8) Goods are accepted on the basis of a preliminary decision of an authorized employee of Master Sport after verification of the Buyer’s compliance with the deadline specified in paragraph 1.

(9) The final decision to accept the return of goods shall be made by an authorized employee of Master Sport after a detailed review and examination of the returned goods.

10. refund of the sale price for returned goods in the amount indicated in paragraph 5 shall be made only in the form of exchange for other Master Sport goods of the same value. The sale price will not be refunded by cash or wire transfer.

(11) In the event that after inspection by Master Sport it is determined that the goods are not suitable for return, the Buyer shall be obliged to take back the goods within 7 days from the date of summons by Master Sport. In such case, the costs of checking the goods described in Section 5 shall be charged to the Buyer and shall be payable by the Buyer within 7 days from the date of Master Sport’s invoice. If the Buyer fails to collect the goods within the period described in the first sentence and fails to pay the cost of checking the goods, the Buyer shall be charged by Master Sport with the cost of storage of the goods in the amount of 1% of the value of the goods for each commenced day of storage of the goods, and in addition, the Buyer’s goods may be secured by Master Sport for reimbursement of the cost of checking and storage of the goods.

(12) The amendment of the content of the GTCs shall not affect the rights and obligations of the Buyer acquired prior to the entry into force of the amendments.
